The AI Revolution—Navigating and Safeguarding Justice in the Digital Age

Although AI holds great potential, it raises significant concerns regarding its misuse.

Palmer points out the influx of sanctions against attorneys, stating, “This misuse of AI demonstrates a trend where attorneys blindly file AI-generated content without exercising the due diligence required to verify its accuracy. This misuse opens a client’s case up to a “nightmare of mistakes” and unfavorable outcomes.”

AI has created new concerns regarding the collection and assessment of evidence, given its capacity to fabricate photos, audio, and other digital materials. To ensure the authenticity of evidence and preserve the integrity of the courts, judges and juries must adapt to these issues and be open to expert analysis to validate the authenticity of evidence.

“Lawyers, paralegals, judges, and the public need to be educated on the capabilities and limitations of AI,” said Palmer. “They must learn to spot the red flags of manipulated content and understand the importance of seeking expert analysis. Just as we have rules governing the use of physical evidence and the testimony of witnesses, we must develop a new framework for handling AI-generated content.”
