Love Your Pet? Then Protect!

June 19, 2015

Attorney Rebecca Palmer appeared on Fox News 35 Good Day Orlando to discuss the concept of including custody of your pet in a Prenuptial Agreement.  Palmer indicated that courts do have jurisdiction to treat pets as an “asset” and decide who receives the asset and what is it worth.  On the air she told of a court incident where one judge actually said that the divorcing parties could take their pet to a park, have a neutral third party hold the dog while they each stepped away from the dog on opposite sides and then the dog would be released.  The court ruled whomever the dog ran too would have custody of the dog and owe the other party $400.  The judge said he didn’t care if the couple wrapped themselves in bacon to curry favor of the dog or used creative tactics and stood by his ruling.  So, getting a Pre-Nup?  Consider adding terms to make it a “Pup-Nup”.
