Mediation Offers an Amicable Path to Divorce and Custody
Family law attorney Rebecca Palmer discusses the advantages of mediation over divorce court proceedings in a column published on 10/29 in the Daily Business Review. Palmer writes that resorting to mediation brings several benefits, including that the process is more collaborative, often faster, and entirely confidential. Furthermore, mediation allows parents to tailor solutions to their particular situation, whereas courts typically apply a one-size-fits-all approach.
“Mediation is a private process, unlike court cases, which are part of the public record and have become a default separation method for many high-profile couples,” Palmer writes. “This confidentiality could be essential for celebrity couples as well as for people who prefer to keep the details of their divorce or custody dispute out of the public record.”
Because mediation sessions and their outcomes are confidential, both sides can speak more openly. Increased communication also results in a faster and more equitable resolution, and both sides need not fear their words will later be used against them.
