The Rise of Gray Divorce is Reshaping Family Law – Til Death (or Retirement)

gray divorceIn a column published 3/28 in Attorney at Law Magazine, Family Law Attorney Rebecca Palmer sheds light on the rise of “gray divorce”– the act of couples divorcing at the age of 50 and up. The population makes up about a third of total divorces in the U.S. and is likely impacted by the increased financial independence of women, empty nest syndrome, and cultural shifts.

 “Healthcare and insurance are also primary concerns for older adults post-divorce,” writes Palmer. Access to quality medical care and continuing health insurance coverage can become major stress points, particularly if one spouse has consistently relied on the other’s benefits.”

 Mediation and arbitration are becoming increasingly popular as they tend to create more tailored solutions that appease both parties and are often less expensive than a court ruling. The financial burden of getting representation is salient for older individuals as they approach retirement.

 “The rise in gray divorce reflects broader societal shifts,” writes Palmer. As these perceptions evolve, so must family law practice adapt to the unique needs of this demographic by continuing to offer alternative dispute resolution methods such as mediation and arbitration.”
