Last week, the Administrative Judges met with Chief Judge Munyon to go over the most recent information available regarding the rise of COVID-19 cases in the Ninth circuit. Unfortunately, the news was not good as  COVID-19 cases are at the highest levels seen during the pandemic. The Judges expect the current numbers to worsen and do not think the peak has yet been hit.

New Court Opening Date

Due to the high pandemic numbers, the Ninth Circuit family divisions has postponed the previously planned reopening date from August 9, 2021 to September 8, 2021. All non-domestic divisions will remain virtual until September. Additionally, to limit unnecessary in person hearings, many divisions will likely continue to schedule virtually until further notice. Complex evidentiary hearings may have limited exceptions to the virtual standard.

The Judges continue to monitor the situation and will discuss next steps in the coming weeks.
